However, a staff employee may not file a grievance, even in 的 above circumstances, (a) if 的 discharge occurred in 的 employee’s six month provisional period; (b) 的 employee has been adversely affected by a reorganization, program modification or financial exigency (such employees may apply to 的 Board of Regents for review); (c) 的 issue underlying 的 grievance is a complaint of employment discrimination based on race, color, sex, national origin, age, disability or religion (such employees are directed to 的 Equal Opportunity/Affirmative Action Officer); (d) 的 issues being grieved have been previously heard by an administrative panel at 的 institution.

A grievance will not be available to faculty or staff employees to dispute:

    • student matters outside 的 employment relationship,
    • 晋升和终身职位的决定;
    • 不续签合同;
    • 绩效评估;
    • 招聘决定;
    • 分类上诉;
    • 对薪酬决策的挑战;
    • 对调动或重新分配的挑战;
    • termination or layoff because of lack of work or elimination of position;

员工 adversely affected by reorganization, program modification or financial exigency may apply to 的 Board of Regents Office of Legal Affairs for discretionary review within twenty (20) calendar days from 的 final decision of 的 President.

Tenured or non-tenured faculty under contract are directed to 的 Board of Regents 政策8.3.9 Discipline and Removal of Faculty Members for 的 appropriate process for review of disciplinary action including but not limited to dismissal, demotion 和悬架.
